Probate Litigation

Will Contests

A will may be contested based on the idea that the will does not reflect the actual intent of the testator. This usually is done on the grounds of lacking testamentary capacity, operating under an insane delusion, or being subject to undue influence or fraud. Will contests are among our specialties.

Trust Disputes

Sometimes, disputes arise regarding the administration of an estate or trust. Negotiation, mediation, or arbitration may be productive in resolving the disputes. If necessary, litigation can be initiated. We can help with this sometimes necessary process.

Breaches of Fiduciary Duty & Beneficiary Rights

If someone with a fiduciary duty (such as an administrator of an estate) misuses or abuses that duty, or if you would like to make sure that yours or another beneficiary's rights regarding an estate are respected and upheld, legal representation can be beneficial. We can provide such representation.

Abuse of Power of Attorney

Similar to fiduciary duty, if someone given power of attorney abuses that power, knowing what your legal options are can be helpful. We can help you understand what they are and/or represent you in legal proceedings.
